Jim Fenwick

Jim Fenwick (James.Fenwick@emwnlaw.com)  is a member of the firm. Mr. Fenwick currently runs the workers’ compensation practice of the firm, but he also manages a thriving caseload of probate claims, as well. Mr. Fenwick joined the Firm in 2018, bringing with him many years of legal experience in workers’ compensation, probate, and estate planning. Prior to coming to Embry Merritt Womack Nance (EMWN), Mr. Fenwick clerked for Judge Margaret Ryan Huddleston in the Warren Circuit Court from 1999 through 2001. Thereafter, he entered private practice with two large insurance defense firms from 2001 through and including 2016.  Mr. Fenwick opened his own solo legal practice in early 2016 under the name Fenwick Law, and that experience led him to merging his practice with EMWN in 2018 due to the continued growth of his solo firm.

Mr. Fenwick has argued and won a workers’ compensation case before the Kentucky Supreme Court in Keith v. Hopple Plastics, 178 S.W.3d 463 (Ky. 2005).  He was also part of the argument team in the Kentucky Supreme Court case Baytos v. Family Dollar, 525 S.W.3d 65 (Ky. 2017). Mr. Fenwick has briefed a multitude of workers’ compensation cases to the Workers’ Compensation Board, Kentucky Court of Appeals, and Kentucky Supreme Court over his many years of practice. In his workers’ compensation practice, Mr. Fenwick has taken a voluminous amount of workers’ compensation Plaintiff depositions while also attending hundreds of Benefit Review Conferences, Final Hearings, and medical expert depositions. Mr. Fenwick also has many years of experience with federal and state black lung defense for numerous carriers and coal companies. Mr. Fenwick was previously a finalist for Chairman of the Workers’ Compensation Board after being selected as one of three finalists by the Workers’ Compensation Nominating Committee.

Mr. Fenwick graduated from Miami of Ohio University in 1996, and he earned his law degree from the University of Louisville’s Brandeis School of Law in 1999.  He was a member of the Journal of Law and Education while in law school, and he had an article published in the Journal regarding the constitutionality of school funding in Kentucky, Tennessee, and West Virginia.  He also received the John S. Greenebaum Public Service Award upon graduating from law school.

Outside of his legal practice, Mr. Fenwick mentors at-risk students at Breckinridge Elementary in Lexington, Kentucky, and he has donated many hours of legal work after working with Southland Christian Church to develop a program to identify individuals and families who require legal help but cannot afford traditional legal representation.
